Police said Alvarez was taken into custody on Sunday night after he allegedly shot and killed neighbor Jonathan Joss following a heated argument between the two men.

Hours after TMZ announced Joss’s death, the actor’s husband, Tristan Kern de Gonzales, claimed on Facebook that the shooting was a hate crime since the suspect allegedly used homophobic epithets at the scene.

Witnesses and San Antonio police, however, have opposed calling the deadly shooting a hate crime, claiming they have not discovered any proof of the accusation.
