Nathan Hochman, Los Angeles County District Attorney, is attempting to postpone Thursday’s resentencing hearing in the Menendez brothers’ case by filing a last-minute motion.

Hochman filed the request Wednesday night in Los Angeles County Superior Court to postpone today’s highly anticipated hearing, stating that the court needs more time to evaluate Erik and Lyle Menendez’s risk assessment evaluation from the California parole board.

As you are aware, Governor Gavin Newsom directed the parole board in February to conduct a risk assessment of the brothers prior to making any clemency decisions.

Hochman stated in a filing acquired by TMZ on Wednesday that the parole board had completed its examination of Erik and Lyle, and that the governor had urged the court to request the final report for the resentencing hearing.

Hochman contends that the court should make every effort to receive the report, and that if additional time is required, the judge should postpone the resentencing hearing, thereby deferring the judgment.

Newsom intends to utilize the findings as part of a June 13 hearing at which Erik and Lyle will each appear before the board for individual evaluations. Following the hearing, Newsom will decide whether to give clemency to the brothers.

Erik and Lyle were convicted of shooting their parents to death with shotguns in their Beverly Hills home in 1989, and they were sentenced to life without parole.

Despite their sentence, the brothers have aggressively worked the judicial system in the hopes of being released from prison, particularly in the last two years. They have sought resentencing, clemency, and a fresh trial based on newly discovered evidence.
